1. Acceptance of Terms

By accessing or using Speed Fleet ("the Service"), operated by Teknulugy on behalf of Al Fahad Kuwaiti Company for Consumer Goods Delivery, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the Service immediately.

2. Description of Service

Speed Fleet is a cloud-based fleet management platform providing real-time GPS tracking, route optimisation, driver management, dispatch operations, predictive maintenance alerts, and analytics dashboards for vehicle fleets operating in the State of Kuwait.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except in cases of emergency maintenance.

3. Account Registration & Security

To use the Service you must:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorised use of your account.
• Ensure all users added to your account comply with these Terms.

You are solely responsible for all activity that occurs under your account. Speed Fleet is not liable for any loss or damage arising from unauthorised account access.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations of the State of Kuwait.
• Transmit any unlawful, harmful, or fraudulent content.
• Attempt to gain unauthorised access to any system or network.
• Interfere with or disrupt the integrity or performance of the platform.
• Reverse-engineer, decompile, or disassemble any part of the software.
• Resell, sublicense, or transfer access to the Service without written consent.
• Use the platform for any purpose other than legitimate fleet management operations.

5. Payment & Billing

Subscription fees are billed in advance on a monthly or annual basis. By providing payment information you authorise Speed Fleet to charge applicable fees to your chosen payment method.

• All fees are stated in Kuwaiti Dinar (KWD) unless otherwise specified.
• Prices are subject to change with 30 days' prior written notice.
• Failure to pay fees may result in suspension or termination of your account.
• Disputed charges must be reported within 30 days of the billing date.

6. Intellectual Property

All content, software, logos, trademarks, and technology comprising the Speed Fleet platform are the exclusive intellectual property of Teknulugy or its licensors. These Terms do not grant you any ownership rights.

You retain ownership of all fleet and operational data you input into the platform. By using the Service, you grant Speed Fleet a limited licence to process that data solely to provide the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Uninterrupted, error-free, or secure operation of the platform.
• Accuracy or completeness of GPS tracking or route data.
• Results obtained from use of the Service meeting specific operational targets.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Speed Fleet and Teknulugy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Speed Fleet, Teknulugy, Al Fahad Company, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service in violation of these Terms.
• Your breach of any applicable law or third-party rights.
• Any content or data you submit through the platform.

10. Termination

Either party may terminate these Terms at any time. Speed Fleet may suspend or terminate your access immediately and without notice if:

• You breach any provision of these Terms.
• You fail to pay applicable fees after a grace period.
• Your use poses a security risk to the platform or other users.
• Required by applicable law or regulatory authority.

Upon termination, your right to access the Service ceases immediately. Data export is available for 30 days post-termination in accordance with our Privacy Policy.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Kuwait. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.

Before initiating legal proceedings, you agree to attempt to resolve any dispute by contacting us at info@speedfleet.online and allowing 30 days for resolution.

12. Changes to These Terms

Speed Fleet reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. For material changes, we will provide at least 14 days' notice via email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
